Question:

My sister was baptized and has since married and had a child. My mother claims the child is Jewish, but how could that be? If Judaism is a religion, if someone leaves it, she’s no longer Jewish, right?

Response:

Logically, I would have to agree with you. If Judaism is a religion, then someone who doesn’t believe in the religion should be no longer Jewish. The reality, however, is that it doesn’t work that way.

Throughout the Tanach, we find Jews breaking every facet of their covenant with G‑d, joining and forming all sorts of idolatrous cults and heathen practices. Yet when the prophets chide them, they are called “My people, Israel.”

The Talmud1 focuses in particular on the precedent of a notorious character named Achan, who appears in the story of the fall of Jericho.2 “Israel has sinned,” exclaims G‑d. “They have transgressed My covenant that I commanded them.” Yet in the story’s narration we discover that the lone sinner is Achan, who took from the spoils of Jericho. The Talmud points out that nevertheless Achan is considered “Israel,” and remarks, “Israel, although he has sinned, is still Israel.”

The choice of precedent is poignant and the wording laden with subtle meaning: Achan has broken “My covenant that I have commanded them”—interpreted by the Talmud to mean not only one detail, but the entire covenant of Torah. Yet he remains not only a Jew, but “Israel”—the entirety of the Jewish People in a single individual.

The principle extends not only to genealogical Jews, but converts as well. In Tractate Yevamot3 we learn that once a person has fulfilled all the requirements of a proper conversion, he is considered “like Israel in all matters.” The Talmud explains those last words to mean that even if this convert would return to his pagan ways, “if he marries a Jewish woman, he has the same status as an apostate Jew, and they are considered married.”

Why does the Talmud choose to discuss Jewishness in terms of whether or not a marriage is valid? This is also precise: When it comes to having this Jew slaughter meat for you, or relying upon him in other areas of kosher and similar matters, his status may indeed be the same as that of a non-Jew. But those are technicalities, dependent on extraneous factors. Marriage, however, is the real test of Jewishness. Even if a non-Jew would marry a Jew with a chupah and a rabbi presiding with all the procedures “by the book,” the marriage does not have the validity of a marriage sanctified in accordance with Jewish law. Saying that “they are considered married” is the best Talmudic language available for “Yes, he is still Jewish.”

Based on the above statement of the Talmud, the Jewish Code of Law4 rules that a marriage between a Jewish man and a Jewish woman who “convert out” is completely valid. Therefore, their children are considered Jewish and could also marry other Jews.

Which brings us to your case, where a Jewish woman has joined another religion and married a non-Jew. In this instance, as well, since Jewishness is matrilineal, her children are considered Jewish.5

Apparently, Jewishness is about neither religion nor race. Unlike a race, you can get in, but unlike religion, once you’re in you can’t get out. As with Achan, once you are a part of this people, you are the entire people. As Israel is eternal, so your bond with them is irreversible, unbreakable and eternal.

This is apropos in my case. Growing up in the Fifties in an Anabaptist Christian sect, I always felt I was Jewish and that a mistake had been made. From the earliest of age, I never believed the Christian narrative. Then 15-17 years ago I had my mtDNA tested and voilà through my mother, I'm a direct genetic descendant of one of the four 1st Century Jewish women who gave rise to 80% of European Ashkenazi Jews. This is 21st century science. This is Genetics. Has the Israeli Rabinate accepted DNA testing as a tool for establishing Jewishness?

No. There are specific laws that dictate who's Jewish and who isn't and DNA isn't one of them. Unless, in your case, you can prove an unbroken female line, e.g. your mother, her mother, her mother, et al., you're not Jewish and it would be necessary to seek an Orthodox conversion.

As the article above states, it is impossible to leave or convert "out" of/from Judaism. If a person was born to a Jewish mother (or converted to Judaism according to Halacha) then they always remain a Jew, regardless of what they do or believe. The children of a woman who "converted" tp a different religion are the same as her, they can never lose their Jewishness, or the privilege and obligation of Judaism.

Per genetic DNA/mtDNA testing and Judaism. Through my mother's maternal line, I am a mtDNA match to one of the four 1st CE Jewish women (K)atherine who gave rise to 80% of the European Ashkenazi Jews. If DNA testing is good enough to prove paternity; is it good enough to prove Jewishness? Also, through my mtDNA testing, I have been contacted by many normal Jewish people in the US, Germany, Poland, Ukraine, Russia, and Israel who share the same mtDNA signature as me. Even as a small child,7/8 years old, I always felt, deep in my soul, that I was Jewish. That some mistake had been made. And even as a young child, I never believed the Christian narrative about Christ. Are Abraham, Sarah, and HaShem reaching out through time, across the centuries to me? I'm not seeking the unearned or some special advantage. I just want to know what the frig is going on. One more little thing, all my life whenever I would say my name, the other person would invariably say Halterman, that's a Jewish name.

It is very confusing. As is clear from the article whether one chooses to or not, one cannot ever leave Judaism. Anyone who is descended from a Jewish woman in their maternal line, is fully Jewish according to Jewish Law. Based on what you write, this would mean that you are Jewish as well. You can explore this further by writing to our Ask The Rabbi service which you can find on the banner almost at the top of this page.

I read and hear all the time that Jewish identity is given maternally, so your mother's mother's mother and so on have to be Jews in order to be classified as a Jew by birth. Does this not work any other way? If your father is a Jew for instance and you have a very Jewish name and everyone assumes you're Jewish and you consider yourself Jewish and you hold Jewish faith like you were taught growing up but your mother is Roman Catholic and has no Jewish heritage herself, are you not a Jew? Would you still have to undergo a proper conversion before you can call yourself a Jew before God/G-d? Can you have done your Bar Mitzvah or is it invalid in His eyes? Also, if you're mother converted before you were born - so she was Roman Catholic but now she's Jewish, does that make the chain start? Thank you in case you respond.

My understanding is that if your mother was converted before you were born, then you are Jewish. If your father only is Jewish, you would need a halachic conversion, which means a conversion done as required by Torah law.

One who lawfully converts is not a "ger" - that person is a Jew. Lawful conversion doesn't mean that someone is symbolically or spiritually a Jew. As strange as it sounds, according to Torah law, a convert may marry his maternal sister after she converts (however the Sages forbade this as it would reflect poorly in actual practice). Similarly, a convert that engages in relations with his maternal sister when she has not converted, is considered to have had relations with a woman with whom he was not related. Yes, it is a strange example, but the point is that a lawful conversion actually produces a physical change, not a symbolic recognition.
1. Regarding the statement in your article, {In Tractate Yevamot 48a we learn that once a person has fulfilled all the requirements of a proper conversion, he is considered “like Israel in all matters.”}
I read the tractate and do not see at all where this is said.

2. I am curious, because a friend told me that a convert is subject to different allowances than a person born a Jew. Like they cannot have all the privileges that Jews have by halachah? I do not understand what this means. Does it mean if you are a man you cannot not have a Aliyah? If the father was a Levi, can the convert who had converted go to an Aliyah as a Levi? Or what if any are the restrictions. If there are no restrictions, can you site another place in the Talmud where this is supported?

3. If there are differences, do these same restrictions also apply if you are a child of an orthodox convert?

4. What kind of documents does an orthodox convert have to produce at the time of a wedding?
There are very few differences in Jewish law between a convert and a person born Jewish. I can think of only two, both dealing with marriage. A female convert, or a female whose parents are both converts, may not marry a Kohen. A convert (male or female) may marry a mamzer. (The term "mamzer," often misinterpreted as meaning a bastard, refers to a child resulting from a forbidden sexual relationship such as incest. A mamzer may only marry another mamzer or a convert.)

A convert can certainly have an aliyah (unless disqualified for reasons unrelated to being a convert). If the father is a Levi, that is of no consequence. A convert is considered a "new person," having no relationship under Jewish law to their biological parents, and has the status of Israel.

What MATTERS is, first, whether your mom's mom's mom was Jewish. If YES, then YES you are a JEW ad you can start to catch up on your Jewish education.

If you are not BORN Jewish (as per your mom's mom, etc) then you can become a GER. That means you read and/or take classes and promise to keep the mitzvot and go into the mikvah as per the orthodox rabbi's instructions. You do NOT inherit your father's status as Levi or Cohen. You become an Israelite (an ordinary Jew, like most of us).

This explains a lot. My great uncles have Jewish servicemen cards from WW2. Also, my mom's explanations to my biblical questions seem to be oral from the Oral Torah. Both my parents have a Judaic understanding of creation, life after death, and eternity. They said, "Catholics have different beliefs about these things" but that never made sense because their beliefs were not what any other Catholics I knew believed. My dad once said we were a "Jewish Catholic" family and I had no idea what that meant! I thought he was saying that because his friends were mostly Jews. I get it now.

What do you mean? Are you speaking of Jews who remained in the Holy Land and remained Jews? Or those who remained hee and became Muslims? Yes, if a woman became a Muslim and married a Muslim, her daughters would still be Jews, and so would their daughters, on down to today. We do not know who these are, so we will have a problem finding them and restoring them to their Jewish heritage. There are more than several high profile men in the U.S. and beyond, born Ashkenazi Jews in Jewish homes, who have huge financial resources and use them with a fixation in support of Jews for Jezus and fund raise by U.S. mail to Christians and their algorithms think are Christian (like me, a Jew) for support in that effort to push for all Jews to "see the light." They call themselves "Jewish Christians" and few people contradict their declaration, which assuages the harm they are doing. Watching and reading conservative news, one knows their names. Some of them missionaries and propaganda to doors all across America. In at least one case the convert's son and his family are integral parts of what they term their "ministry to the Jews." Does the concept of "rodef" (a pursuer who is after you and will harm you) not apply to these people? They are devoted to tearing people from Am Yisrael. What are the bases for rabbinical court excommunication from the Jewish people?

Shalom aleichem my fellow Yiddin. Wonderful article, so thank you Rabbeinu Nelson. Indeed, in Judaism halachicly, even if someone is lead astray from Judaism or serves idols or practices a foreign belief, one is Jewish still if they either are a convert according to halachic standards, have a Jewish mother, or both.

I read this information before but was troubled today because I forgot the truth, and this article gave me peace of mind. I am completely Jewish and have 100 percent Jewish ancestry on both my mom and dad's sides of the family. Unfortunately I temporarily considered myself a gentile and served an idol and didn't serve Hashem in my teen years. I probably lead many people astray too, sadly. But Baruch Hashem, I have done Teshuvah for serving an idol and erroneous beliefs and have returned unto the one G- d of Bnai Yisroel. Even more, I know from this article that I am still considered a Jew and Baruch Hashem, I don't have to do any conversions. Shalom to all.

Today's Jews are all descended from Sarah. Judaism goes according to the mother regardless of whether she was observant or not, or knew she was Jewish or not. A Jew is a Jew is a Jew, a soul is a soul is a soul.
As for your second question, we accept converts because Hashem said we can. Hashem gave us the Torah, which has in it laws for how to convert. The Rabbis are upholding the Torah. If it's easy, it's probably fake. Becoming and being Jewish is anything but easy.

On the one hand, the barriers to potential Jews are too difficult. Many good Jews are delayed unnecessarily.

On the other hand, there must be some difficulty. A person may love Jewish law without loving Jews. A person may love Jewish law and also Jews without having a good idea how difficult it is to live a Jewish life when this is learned in adulthood. It takes effort to keep Shabbat. It takes imagination to figure out how to get everything done in six days instead of seven. It takes experience to feel Shabbat as a delight. It also takes courage to know that many of your friends and relatives, and many strangers, will hate you for becoming a Jew, and some will actively seek to kill Jews (which, after conversion, includes you--these people target places of worship as well as markets will sell kosher food). In the course of learning these difficulties not only as theoretical facts but also as personal experiences, a potential Jew may well change his/her mind and decide not to convert.

For example: by halachah, if you find unidentified meat in a town in which the majority of butchers are kosher, you can take the meat and eat it, because it is "considered kosher". You can't be sure, it has no hechsher, but it is "considered kosher" in spite of the doubt. A convert, for example: is he merely "considered" like Israel in all matters, or is he indisputably like Israel in all matters? Or the halachah you cite: if a marriage between a Jewish man and a Jewish woman who “convert out” is completely valid, then are their children merely "considered" Jewish, or are they definitively Jewish?

If a married Jewish couple decide to "convert out" they are still Jews, and the woman's children are also still Jews. Once a Jew, always a Jew. You can't "convert out." If you try to convert out, you become guilty of idolatry, which makes you a very sinful Jew, but you are still a JEW. You are not "considered" a Jew. You ARE a Jew.
Many Reform and Conservative Jews had a mother or grandmother who "became a Jew" by conversion--but their conversion did not require these women to promise to keep Torah, so those "conversions" were invalid. So their children are NOT JEWISH after all. If the child of such a mother is female, then HER children are also NOT JEWISH. But before they can marry an orthodox Jew, their records are checked. If their Jewish status is not valid, they can still convert. Otherwise no Orthodox rabbi will perform the wedding. IF they marry with a non-orthodox rabbi, THEIR children are ALSO not Jews. Those of us who know that their maternal ancestor kept kosher are lucky.

Catholic Jews Pretending to be Jewish

My maternal grandparents were Jewish and converted to Catholicism back in Poland. Because they moved a lot they passed as gentiles unaffected by WW2. No one ever suspected their Jewish background.

In Judaism my family is considered Jewish. We are practicing Catholics. We are not even connected to Jewish culture but Polish Catholics, we lived in a Polish neighborhood, spoke Polish at home and went to Polish church.

My grandparents immigrated from Poland in 1967. A Jewish organization paid for everything and found them housing in the US. My grandparents pretended they were still practicing Judaism to get Jewish organizations to help them.

They told me that in Judaism, they were considered Jewish hence there was nothing wrong with getting help from Jewish organizations. They even suggested their grandchildren apply for scholarships meant for Jews and pointed out that a lot of Jews pretended to be Catholic during the war, that they simply did the opposite. Is this kosher?

Hello Anthony,
Yes, of course, you are still Jewish. Don't be ashamed of what happened in the past. You are you and if you choose to believe and follow the Jewish faith that is up to you. You don't have to convert but if you choose to that is up to you. Just follow your heart.

They should definitely return to the fold, though whenever there is a break from the community they will need to present some evidence that they are truly Jewish through the maternal line. I believe because they should be encouraged to return to Judaism, any interaction they have with Jewish organizations would only be a plus, as this exposure could help them reconnect with who they really are.

I have a question. According to my Dad, my Mother was a convert, but my Mother parted ways from my Jewish Dad when I was 13 and I am now going on 55 years of age. I have no proof of this conversion. Only the word of my Dad and his siblings who also knew but all passed away. My mother was no longer in contact with us for many years after they separated. I had heard from a family member from my mother's side that she passed away a few weeks after my Dad 4 years ago. We also lost most of our possessions in a fire about 10 years ago, The only record I have is that of my father's old birth certificate, that shows my grandmother listed as being from Istanbul and my grandfather from Salem. My father was a long time member of the Sephardic Jewish Center n our area and a close friend of the Rabbi, but I believe the majority of the people who knew him have passed away. If I want to make Aliyah would I still be able to?

Are you in the U.S? I read somewhere that Orthodox conversions are often filed with the Rabbinical Council of America or the American Jewish Archives. It's worth a try to see if there's any record of your mother's conversion.

I discovered that my paternal grandmother was Jewish , but married to a Christian man. I became so interested in this background situation and decided to convert to Judaism beginning my freshman year at the University of Alabama. By the end of my formal education, a B.S. and Masters Degree, I was completely converted and remain so today. It just felt right to me and I have never regretted my decision to convert.

Judaism is a culture, a people apart from others. We can be identified by our ethnic surnames, Semitic features and our liturgy and sacraments. We are Jewish in lineage by birth, regardless of a Jew’s desire to separate from their faith to join another.

My family research has revealed many Jewish ethnic names and since having my DNA tested I have received many matches for distant cousins who are Jewish and practicing their Faith. For me, this is a great gift. It has brought me so much closer to the roots of my Faith and I am now studying Judaism to learn more about the culture and the Law. I think it s a beautiful and loving way of living and I am so glad to have this in my life.
